The new CSPA rules Final Proposed Rules will be discussed at the Joint Legislative Committee on Administrative Rules (JLCAR) meeting tomorrow, February 15. 2008. The rules hearing will take place at approximately 9:30am, although the timing is not etched in stone.

We still have great concerns about the potential for DES to be overwhelmed by the volume of permit requests after April 1st. For this reason, we believe there may need to be some built-in review of the rules in a few months to make sure things are operating smoothly. As the law takes effect on April 1st regardless of the rules status, we believe these rules are necessary so that projects may progress and permits may be issued pursuant to the new CSPA statutory standards. We hope things work out.
